Terms & Conditions

These terms govern your use of AirTrader (airtrader.co.uk), the online marketplace for buying, selling and sharing aircraft across the UK and Europe. By accessing or using the site, creating an account or placing an advert, you agree to these terms. If you do not agree, please do not use the site.

1. About AirTrader

AirTrader provides an online platform that connects private sellers and brokers (“sellers”) with prospective buyers (“buyers”). We are a venue for advertising aircraft and aircraft shares only.

AirTrader is not a party to any transaction between buyers and sellers. We do not own, sell, inspect, value, test, endorse or take custody of any aircraft listed, and we are not an agent, broker, surveyor or adviser for either party. Any sale is concluded directly between the buyer and the seller.

2. Eligibility and your account

You must be at least 18 years old and able to enter into a legally binding contract to use AirTrader. You are responsible for keeping your account details and password secure and for all activity under your account.

You agree to provide accurate, current and complete information and to keep it up to date. We may suspend or close accounts that breach these terms.

3. Listings and advertising fees

Placing an advert is a paid service. Current fees are a Standard listing at £79 and a Featured listing at £175, with discounted bundles available to registered broker accounts. Prices are shown at checkout and may change from time to time.

Advertising fees are charged before your advert goes live and are processed securely by our payment provider, Stripe. AirTrader does not store your full card details.

Advertising fees pay for the placement of an advert, not for a sale. Fees are non-refundable once an advert is live, except where required by law. We may decline, edit or remove any advert at our discretion — for example if it is inaccurate, unlawful, or breaches these terms.

4. Seller responsibilities

If you place an advert, you confirm that:

  • you are the legal owner of the aircraft or share, or are authorised to advertise and sell it;
  • all information, photographs, specifications, hours, history and pricing you provide are accurate, complete and not misleading;
  • the aircraft and the sale comply with all applicable laws and regulations; and
  • you will respond to genuine buyer enquiries honestly and in good faith.

You are solely responsible for the content of your advert and for the sale, including any representations, warranties, taxes (such as VAT) and transfer of title.

5. Buyer responsibilities and due diligence

Buyers must carry out their own due diligence before purchasing. This includes, where appropriate, an independent pre-purchase inspection or survey, a review of logbooks and maintenance records, and verification of ownership, airworthiness and registration.

Listings are provided by sellers, not by AirTrader. We do not verify the accuracy of any listing and you should not rely on AirTrader, or on any listing alone, when deciding to purchase.

6. Airworthiness and regulatory compliance

Aircraft are subject to strict regulation. Responsibility for airworthiness, certification, maintenance, registration and compliance with the requirements of the CAA, EASA and any other relevant authority rests entirely with the buyer and seller. AirTrader provides no regulatory, airworthiness, legal, tax or financial advice.

7. Payments and funds

AirTrader charges advertising fees only. We do not process the purchase price of any aircraft and never hold buyer funds. Any escrow service referenced on the site is optional and provided by independent third parties under their own terms.

8. Acceptable use

You agree not to:

  • post false, misleading, fraudulent or unlawful content;
  • advertise anything other than genuine aircraft or aircraft shares you are entitled to sell;
  • infringe the intellectual property or other rights of any person;
  • scrape, copy or harvest data or content from the site without our consent;
  • attempt to disrupt, damage or gain unauthorised access to the site or its systems; or
  • use the site or other users’ contact details for spam or unsolicited marketing.

9. Supplier and services directory

Our directory lists third-party suppliers (such as insurers, finance providers and training organisations) and links to external websites. These listings and links are provided for convenience only and do not constitute an endorsement or recommendation. Your dealings with any third party are solely between you and that third party.

10. Intellectual property

The AirTrader name, logo, design and the content we create are owned by us or our licensors and are protected by law. You retain ownership of the content you upload but grant AirTrader a non-exclusive, royalty-free licence to host, display and promote your advert on the site and in related marketing while it is live.

11. Disclaimers

The site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties about the accuracy, completeness, quality or availability of any listing, supplier or the site itself, and we do not guarantee that the site will be uninterrupted or error-free.

12. Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law.

Subject to the above, AirTrader is not liable for any loss arising from a transaction between a buyer and a seller, from reliance on any listing, or from your use of any third-party supplier. We are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill. Our total liability to you in connection with the site is limited to the amount of advertising fees you paid to us in the 12 months before the claim arose.

13. Indemnity

You agree to indemnify AirTrader against any claims, losses and costs arising from your adverts, your use of the site, your sale or purchase of an aircraft, or your breach of these terms.

14. Suspension and termination

We may suspend, restrict or terminate your access to the site, and remove any advert, at any time if you breach these terms or if we reasonably consider it necessary to protect the site or other users.

15. Changes to these terms

We may update these terms from time to time. The version published on this page applies to your use of the site. We will update the “last updated” date when changes are made; significant changes may be notified to account holders.

16. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that if you are a consumer you may also benefit from any mandatory protections of the country in which you live.
